Srinagar, Aug 18 (JKNS): A local court in Pampore on Monday convicted the accused in a decade-old assault and outraging modesty case, sentencing them to two months of rigorous imprisonment along with a fine of ₹10,000.
Details available with news agency JKNS that in case of default in payment, the convicts will undergo an additional one-month simple imprisonment. The magistrate further directed that the fine amount, once realised, be disbursed as compensation to the complainant.
The case dates back to 2015 when the complainant alleged physical assault on her and her family, besides damage to property, during an altercation. She also stated that her modesty was outraged in the incident.
During the course of trial, the prosecution relied on medical records, witness depositions, and other material evidence, which the court found credible and consistent.
After evaluating the testimony and evidence, the Judicial Magistrate Ist Class Pampore ruled that the prosecution had successfully proved charges under sections 354, 323, and 427 of the Ranbir Penal Code.
The prosecution was conducted by Assistant Public Prosecutor Naveed Sarwar Khan, whose effective presentation and preparation of the case were noted as instrumental in securing the conviction.
In its judgment, the court observed that offences affecting personal dignity and social harmony cannot be dealt with lightly. It stressed that the sentence must serve as both punishment and deterrence.
The magistrate maintained that victims are entitled not only to recognition of their grievance but also to compensation, reinforcing that the rule of law must prevail. (JKNS)
