Srinagar, Oct 17 (JKNS): The Chief Judicial Magistrate (CJM) Sopore has issued a proclamation order against Hizbul Mujahideen chief Syed Salahuddin, declaring him an absconder in connection with a 2012 case registered under the Ranbir Penal Code.
As per news agency JKNS, Salahuddin, whose actual name is Mohammad Yousuf Shah of Soibugh, Budgam, is facing proceedings in FIR No. 67/2012 registered under Sections 153-B (promoting enmity) and 506 (criminal intimidation) RPC.
The order was passed by CJM Mir Wajahat on a request moved by the SHO Police Station Dangiwacha through the Additional Public Prosecutor under Section 87 CrPC, which now corresponds to Section 84 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
The court noted that despite the issuance of a general arrest warrant, Salahuddin has remained untraceable and is deliberately evading arrest.
Observing that the statutory requirements for proclamation were fulfilled, the CJM directed Syed Salahuddin to appear before the court within 30 days from the date of publication of the proclamation.
The order further stated that in the event of failure to appear, proceedings under Section 83 CrPC / Section 85 BNSS will be initiated for declaring him a proclaimed offender and for attachment of his property. (JKNS)
