Shopian Bans Loudspeakers in Markets, Vehicles to Curb Noise Pollution

Shopian, Jan 1 (JKNS): In a strong move to tackle rising noise pollution and protect public peace, the District Magistrate (DM) Shopian, Shishir Gupta, has imposed a complete ban on the use of loudspeakers, public address systems, microphones and other sound-amplifying devices in markets and on vehicles across the district.

As per news agency JKNS, The order has been issued under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, following repeated complaints and official observations regarding excessive noise, particularly in Shopian town and other busy market areas.

According to the order, the district administration noted that shopkeepers, vendors and hawkers were routinely using loudspeakers and amplifiers to attract customers, creating a “cacophony” that disturbed residents, shoppers, elderly people and patients. The DM observed that unabated noise in public and residential areas was adversely affecting health, safety and overall quality of life.

The administration has also taken serious note of vehicles, including vans, auto-rickshaws and handcarts, fitted with loudspeakers for promotional announcements, which were found to be significantly contributing to noise levels beyond permissible limits.

The order further flags noise from public address systems, excessive vehicular honking, generator sets, construction activities and social or religious gatherings as constituting public nuisance.

Citing Article 21 of the Constitution of India, the DM stated that protection from hazardous noise pollution is an integral part of the right to life and a wholesome environment. The order also refers to the Noise Pollution (Regulation and Control) Rules, 2000, notified under the Environment (Protection) Act, 1986.

Effective immediately, the use of loudspeakers, microphones, amplifiers or any sound equipment by shopkeepers, vendors and hawkers for advertising or sales purposes has been prohibited, and all such devices must be removed or disconnected. The use of vehicles fitted with loudspeakers or sound systems for announcements or advertisements has also been banned unless specifically permitted under rules.

To ensure strict enforcement, the DM has directed the Senior Superintendent of Police (SSP) Shopian to implement the order on the ground. Police have been authorised to seize sound equipment used in violation of the ban. Tehsildars and Sub-Divisional Magistrates have been instructed to act promptly on complaints and initiate legal action against violators, while municipal authorities have been asked to publicise the order.

The ban will remain in force for a period of two months from January 1, 2026, unless extended or withdrawn earlier. The administration has warned that strict legal action will be taken against anyone found violating the order. (JKNS)
