Srinagar, Sep 16 (JKNS): The Jammu and Kashmir Government has terminated the probation of Mir Omar Bin Farooq, a Multi-Tasking Staff (MTS) employee, and discharged him from government service over unauthorized absence from duty.
According to Government Order No. 696-JK(HME) of 2026 dated September 15, a copy of which lies with news agency JKNS stated that, Mir Omar Bin Farooq was appointed under the Jammu and Kashmir Rehabilitation Assistance Scheme, 2022, and joined his duties at Government Medical College, Baramulla, on January 3, 2026.
The order states that he remained absent from duty with effect from January 20, 2026, without obtaining prior sanction of leave from the competent authority.
The official had applied for study/other leave for 30 months and left the station without awaiting orders or approval on his leave application.
The Principal, Government Medical College, Baramulla, subsequently issued show-cause notices on January 31 and February 17, directing him to resume duties and informing him that study leave was not admissible as he had not completed the prescribed five years of qualifying service.
Despite the notices, the order states, the official neither resumed duty nor furnished a satisfactory justification for his continued absence and instead persisted with his request for leave to pursue higher studies.
A final notice was issued by the department on May 25, cautioning him that failure to resume duty would invite appropriate action, including termination or discharge under Rule 21(1) of the J&K Civil Services (Classification, Control and Appeal) Rules, 1956.
In his response, the official expressed willingness to continue in government service but sought relaxation of the applicable rules and grant of study leave without pay.
The Government order states that the request could not be acceded to, noting that submission of a leave application does not authorise an employee to remain absent unless the leave is duly sanctioned by the competent authority.
The matter was also referred to the General Administration Department, which clarified that the Health and Medical Education Department is the cadre-controlling as well as disciplinary authority and may initiate disciplinary action against the official at its own level.
Accordingly, exercising powers under Rule 21(1) of the J&K Civil Services (Classification, Control and Appeal) Rules, 1956, the Government terminated the probation of Mir Omar Bin Farooq and discharged him from government service with effect from January 20, 2026. (JKNS)
