Srinagar, May 31 (JKNS): The Directorate of Youth Services and Sports (YSS), Jammu and Kashmir, on Sunday refuted allegations regarding the withholding of salary of Physical Education Teacher (PET) Bilquis Mir for over two years, asserting that the matter is linked to non-availability of mandatory service records and ongoing scrutiny of several service-related issues, and not any arbitrary or mala fide action by the department.
It has come across a news report regarding the alleged denial of salary to Ms. Bilquis Mir, Physical Education Teacher (PET), for more than two years. In view of various claims made in the said news article, it has become necessary to place the correct factual position before the public, spokesperson of JK-YSS said in a statement issued here to news agency JKNS.
The report that the Department has arbitrarily withheld salary or acted with mala fide intent is factually incorrect. The release of salary requires verification of the Service Book, Last Pay Certificate (LPC), pay fixation details, admissible pay and any recoveries, wherever applicable.
It is further clarified that upon receipt of the interim order dated 05.02.2026 passed by the Hon’ble Central Administrative Tribunal, the matter was immediately taken up for compliance and referred to the concerned authorities for necessary action. During the process, the Principal, BHSS Nowpora, Srinagar, who is the concerned Drawing and Disbursing Officer (DDO) in respect of the post presently held by Ms. Bilquis Mir, reported that although she had joined the institution, her Service Book, Last Pay Certificate (LPC) and other relevant service records had not been received. It was further reported that in the absence of these essential records, the salary case could not be processed in accordance with the prescribed financial procedure.
Consequently, the Department initiated steps for obtaining the requisite records and information from the concerned authorities, including the Anti-Corruption Bureau, so that the matter could be processed in accordance with law and the directions of the Hon’ble Tribunal, spokesperson of the YSS said.
It is further pertinent to mention that the issues presently under examination are not confined to salary-related matters alone. The service record of Ms. Bilquis Mir reflects several instances which have necessitated administrative scrutiny, including participation in activities and foreign visits without obtaining prior permission from the competent authority, continued association with and representation of the Indian Kayaking and Canoeing Association (IKCA) at various official and non-official fora without the requisite approval, and other matters relating to compliance with the Jammu and Kashmir Government Employees (Conduct) Rules, 1971, statement reads.
While these issues are distinct from the question of salary and are not being cited as grounds for withholding any admissible salary, they do reflect matters which are presently the subject of departmental examination. It is also observed that instead of allowing the established legal and administrative processes to take their course, attempts are repeatedly being made to project a one-sided narrative through media and social media platforms, thereby creating an impression which is not borne out by the official record.
It is also important to point out that Ms. Bilquis Mir, who was appointed as Physical Education Teacher (PET) in the Youth Services and Sports Department in July 2009, has neither undergone nor completed the mandatory B.P.Ed. training prescribed under the terms and conditions of her appointment order, which is a fundamental requirement attached to the post.
During her deputation to the J&K State Sports Council, initially for a period of two years in July 2013 and subsequently extended in July 2015, she was promoted to the rank of Junior Coach with pay enhancement. She was further designated as In-charge Executive Director, Water Sports Centre, J&K Sports Council, in the year 2019 in her own pay and grade, without concurrence of the parent department.
The Directorate also received a reference from the Anti-Corruption Bureau (ACB), J&K indicating her involvement in illegal promotions during her deputation to the J&K Sports Council and recommending recovery of an amount of Rs. 12,46,928/- allegedly drawn as excess salary with effect from 09.07.2014. Although the criminal proceedings against her were subsequently quashed by the Hon’ble High Court of Jammu & Kashmir and Ladakh, issues relating to violation of service conditions, receipt of benefits not otherwise admissible under rules and other service-related matters continue to remain under examination in accordance with law.
At present, despite her repatriation to the Directorate as a Physical Education Teacher, she has continued to function in various capacities as a representative of the Indian Kayaking and Canoeing Association (IKCA) at official and non-official fora without obtaining prior permission from the competent authority, thereby attracting the provisions of Rule 21(2) of the Jammu and Kashmir Government Employees (Conduct) Rules, 1971.
During the course of her service, she also undertook multiple foreign visits without obtaining prior permission/NOC from the competent authority. Her case for permission to travel abroad could not be processed on certain occasions due to non-submission of the mandatory online property returns as required under the applicable rules. While she has sought to justify such visits on the ground that she was representing India at international events, participation in such events without prior permission and sanctioned leave is a matter requiring examination under the applicable Conduct Rules.
In view of these circumstances, a Show Cause Notice dated 11.07.2025 was issued to Ms. Bilquis Mir calling upon her to explain why action under the relevant service rules should not be initiated in respect of the issues noticed during scrutiny of her service record.
It is also pertinent to mention that a fact-finding Departmental Committee is presently conducting an inquiry into various service-related issues concerning Ms. Bilquis Mir.
The Directorate reiterates its commitment to transparency, fairness, accountability and adherence to the rule of law. The matter is presently under examination at various levels and is also the subject matter of proceedings before the competent judicial forum. Any narrative suggesting deliberate inaction or arbitrary conduct on the part of the Department is not borne out by the official record. The Directorate shall continue to act strictly in accordance with law, the applicable service rules and the directions of the competent judicial forums. (JKNS)
